Nine things you CANNOT do regardless of Do Not Call Registry

The following are practices or tactics that REALTORS® cannot do via phone regardless of the National Do Not Call Registry.

    1. Call any residential phone number using an artificial voice or prerecorded message.
    2. Send unsolicited advertisements to fax machines. An advertisement is not unsolicited if it is transmitted to any person with that person’s prior express invitation or permission.”
    3. Use auto-dialers in a way that occupies two or more phone lines of a multiline business phone at the same time.
    4. Disconnect a telemarketing call prior to 15 seconds of ring time or four rings, whichever is longer.
    5. Abandon more than three percent of calls that are answered by a person. This means the caller has two seconds to respond to the greeting from the answering party.
    6. Use an auto-dialer or any technology for the purpose of determining whether a line is a phone or a fax line.
    7. Make more than one call as part of a telemarketing campaign across state lines, without legal advice as to compliance with additional regulations governing interstate telemarketing.
    8. Disable caller identification features or use caller ID blocking devices.
    9. Make any telephone solicitation to any residential telephone subscriber before 8 a.m. or after 9 p.m. local time at the party’s location.
